You may be eligible for "PERM":

Foreign workers in the United States are eligible for PERM, which will take effect March 28, 2004.  According
to law, in order for a United States employer to hire a foreign worker, the employer must obtain
labor
certification
for the employee. Prior to PERM, this labor certification process could take many years. Under
PERM, one can receive an answer in 45 to 60 days.

After  obtain labor certification is granted, the employer can immediately request an immigrant visa. If the
employee receives the visa, he/she may then immigrate to the United States or change "status" while here in
the United States.

PERM is the new way of filing labor certifications, thus eliminating the previous methods: Reduction in
Recruitment  ("RIR") and the ''traditional,'' e.g., DOL-monitored, system. Effective
March 28, 2005, all
labor certification filings
must be PERM compliant.

PERM requires that an employer perform certain recruitment for an open position prior to filing a labor
certification application. Filing can be done either electronically or by mail using the form ETA 9089.
Rather than submitting the recruitment documentation with the application, the employer will attest on
the new form to completing the required recruitment and will retain the recruitment documentation for five
years in case of DOL audit.

Furthermore, the employer is compelled to obtain a prevailing wage determination from the State
Workforce Agency (SWA) prior to filing the application for labor certification (ETA 9089).

The exciting news for employers is that labor certifications may be approved as quickly as in sixty days.  
Most changes in the final PERM regulation are favorable to employers.
